Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ai2 website at ai2.design, together with the associated documentation, registry endpoints, MCP server and tools (collectively, the "Service"). The Service is operated by BEY AGENCY LTD ("we", "us" or "our"), a private limited company registered in England and Wales under company number 16435596, whose registered office is at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.

These Terms form a legally binding agreement between you ("you" or "your") and us. By accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by any policies referred to in them. If you do not agree, you must not access or use the Service.

These Terms take effect on the date you first access the Service and continue to apply for as long as you use it. The version identifier and the date of last update are shown at the top of this document.

Important: the open-core components distributed through the registry are licensed to you under the License, not under these Terms. These Terms govern your use of the website and the surrounding services. Where the two documents address different subject matter, each applies to its own subject matter; the License governs your rights in the component code itself.

You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

If you use the Service on behalf of an organisation, you represent and warrant that you are authorised to bind that organisation to these Terms, in which case references to "you" mean that organisation, and the organisation accepts these Terms.

The Service is provided on an early-access, actively developed basis. Features may be added, changed, suspended or removed at any time, and parts of the Service may be incomplete or experimental. We give no guarantee as to uptime, performance, feature availability or support response during this period.

We currently operate the Service without user accounts. Where we need to notify users of a material change, we may do so by publishing an updated version of the relevant document and, where you have subscribed, by email.

The Service comprises, among other things, the following elements:

• The registry, which serves component definitions that you may install into your own projects using the shadcn command line tool (for example, npx shadcn add @ai2/<name>) or via the MCP server.
• The documentation, which describes the components, their variants and their intended use.
• The MCP server, which allows AI agents to query the catalogue, documentation and registry.
• The tools, currently the Extractor and the Inspiration Gallery, described in sections 7 and 8.

The open-core components themselves are made available free of charge and their use is governed by the License, not by these Terms. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to access and use the website and services for your own personal or internal business purposes. Nothing in these Terms transfers ownership of any part of the Service to you.

You do not need an account to browse the Service, to install the open-core components, or to use a paid licence. There are no usernames and no passwords anywhere on the Service. Paid access works through a licence key: your key is issued by our merchant of record and emailed to you on purchase, and you enter it in the accountless licence portal to reach the downloads for your tier. You are responsible for keeping your licence key confidential; anyone holding it can use it, and you should treat it like a password rather than a discount code.

Downloads are delivered by email rather than as a direct file stream: when you request a product, we send a delivery link to the email address on the licence. Requests are subject to a fair-use limit, currently twelve downloads per rolling twelve hours per licence, counted against the licence rather than your IP address. The limit protects a leaked key from being drained; the figure in force is shown in the licence portal, and section 9 applies to any attempt to evade it.

The Service offers newsletter and waitlist email forms that use a double-opt-in step: after you submit your address we email you a confirmation link, and you are only added to the list once you click it. You can unsubscribe from any email at any time. Our handling of personal data is described in the Privacy Policy at /legal/privacy.

When you submit a URL to the Extractor, we load that URL in a headless browser and return the design characteristics we could observe: tokens, an inspector view, an accessibility matrix, an image-strategy summary and the page metadata. The Extractor is rate-limited (currently to approximately two runs per rolling twenty-four hours per IP address). Results are held at a private link for a limited period (currently around two hours) and then expire. No account is required.

By submitting a URL you represent and warrant that:

• The URL points to a publicly accessible web resource.
• You have the right to submit that URL and to have it loaded and analysed through a third-party service.
• The resource does not contain material that is unlawful, infringing, defamatory or otherwise something you are not entitled to process.
• The URL does not target internal, private, local or otherwise non-public network resources, and you will not use the Extractor to probe infrastructure, circumvent access controls or carry out server-side request forgery.

You retain any rights you hold in the URLs you submit. You grant us a worldwide, royalty-free, non-exclusive licence to process each submission solely to operate and secure the Service for the limited duration described above. We may refuse, rate-limit, queue or stop processing any submission at our discretion, in particular where we consider it unlawful, abusive or a risk to the Service or to third parties.

The Inspiration Gallery is an editorial catalogue in which we comment on the design language of publicly accessible third-party sites. Third-party names, screenshots and trademarks appear there for the purposes of commentary, criticism, review and education, in reliance on the fair dealing exceptions recognised under the Copyright, Designs and Patents Act 1988 and analogous provisions in other jurisdictions.

Inclusion in the Inspiration Gallery does not imply any partnership, endorsement, affiliation or sponsorship by, or any commercial relationship with, the third-party site or its owners. All third-party trademarks, logos, designs and screenshots remain the property of their respective owners and are used solely for identification and commentary.

If you are the owner of a third-party site featured in the Inspiration Gallery and you wish it to be removed, you may contact us at hello@ai2.design. Acting on a removal request is not an admission by us of infringement or of any other liability.

You agree to use the Service lawfully and in accordance with these Terms. In particular, you must not, and must not permit any third party to:

• Access the registry, documentation or MCP endpoints in a manner that exceeds any published rate limits, or that scrapes, overloads or disrupts the Service.
• Resell, relicense or otherwise commercialise access to the registry or to the Service, or pass it off as your own product.
• Circumvent, disable or interfere with any security, rate-limiting, authentication or access-control feature of the Service.
• Use the Service for any unlawful, infringing, fraudulent or harmful purpose, or to misrepresent any affiliation with or endorsement by us.
• Introduce any malware, or attempt to gain unauthorised access to the Service, to the systems on which it runs, or to any data that is not intended for you.

The open core, the documentation and the currently available tools are provided free of charge. Paid tiers (Pro and Ultimate) are one-time purchases with lifetime access to the tier you buy, offered under the pricing and terms published on the pricing page.

Paid tiers are provided by BEY AGENCY LTD, the licensor, and sold through Polar Software, Inc., our merchant of record. Polar processes the payment, handles your card details, and is the seller of record for the transaction; its own terms also apply to that purchase. On purchase you receive a licence key by email. Where we accept sponsorships or similar arrangements, they are governed by the specific terms published for them.

As merchant of record, Polar is responsible for calculating, charging and remitting any applicable VAT or sales tax on your purchase. You remain responsible for any other taxes or duties that apply to you. Refunds are handled in accordance with the Refund Policy at /legal/refund and with your statutory rights.

All right, title and interest in and to the Service, including the website, the documentation, the token schemas, the curator notes and the software that runs the Service, together with all related intellectual property rights, are and remain the exclusive property of BEY AGENCY LTD and its licensors, save for the open-core components, which are made available under the License.

The "ai2" name, logo and other marks used on the Service are not licensed to you by these Terms. Nothing in these Terms grants you any right to use them, and any goodwill arising from their use accrues to us.

Third-party names, trademarks, logos and screenshots appearing on the Service, including in the Inspiration Gallery, belong to their respective owners and are used for identification and commentary only.

The Service is built on and interoperates with third-party software and services, including Radix primitives, Tailwind CSS, the Lucide icon set and our hosting and infrastructure providers. The components you install may in turn depend on third-party packages.

Your use of any third-party software or service is subject to that third party's own licence and terms. We are not responsible for third-party software or services, and their inclusion does not imply any endorsement by, or affiliation with, the relevant third party.

To the fullest extent permitted by law, the Service and all Content are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express, implied or statutory. In particular, we do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that any extracted tokens, curator notes or other output are accurate, complete, up to date or fit for any particular purpose.

Nothing in these Terms affects any statutory rights that you have as a consumer and that cannot be excluded or limited by agreement. Those rights continue to apply alongside these Terms.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the law of England and Wales.

Subject to the paragraph above, and to the fullest extent permitted by law, we will not be liable to you for any indirect or consequential loss, or for any loss of profits, revenue, goodwill, data, anticipated savings or business opportunity, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, even if the loss was foreseeable.

Subject to the first paragraph of this section, our total aggregate liability arising out of or in connection with the Service and these Terms will not exceed the greater of (a) the total amount paid for your ai2 licence in the twelve months immediately before the event giving rise to the claim, whether that amount was paid to us directly or to Polar Software, Inc. as our merchant of record, or (b) one hundred pounds sterling (GBP 100). If you use only the free open core and have not bought a paid licence, that amount is GBP 100.

You agree to indemnify and hold us, our directors, officers, employees and contractors harmless from and against any claims, liabilities, damages, losses and reasonable expenses (including reasonable legal fees) arising out of or connected with: (a) your use of the Service; (b) any URL or other material you submit through the Service; (c) your breach of these Terms; or (d) your infringement of any third-party right, including intellectual property or privacy rights. This section does not apply to the extent a loss arises from our own breach of these Terms or from a liability we cannot lawfully exclude.

We may suspend, restrict or terminate your access to all or part of the Service at any time, with or without notice, where we reasonably consider it necessary, including where you breach these Terms or the acceptable-use provisions, or where your use poses a risk to the Service, to us or to third parties.

You may stop using the Service at any time. Any provision of these Terms that by its nature should survive termination, including those relating to intellectual property, disclaimers, limitation of liability, indemnification and governing law, will continue to apply after termination. Components you have already installed under the License remain governed by that document.

We may update these Terms from time to time to reflect changes to the Service, to our practices or to the law. When we do, we will revise the version identifier and the date of last update shown at the top of this document, and, where the change is material, we will take reasonable steps to bring it to your attention.

Your continued use of the Service after an updated version takes effect constitutes your acceptance of the revised Terms. If you do not agree to a change, you must stop using the Service.

These Terms and any dispute or claim arising out of or in connection with them, their subject matter or their formation (including non-contractual disputes or claims) are governed by and construed in accordance with the law of England and Wales.

The courts of England and Wales will have exclusive jurisdiction over any such dispute or claim. If you use the Service as a consumer, nothing in this section deprives you of the protection afforded by the mandatory law of your country of residence, and you may also be entitled to bring proceedings in the courts of that country.
